By booking a reservation with Green Springs Inn, you agree you have reviewed and accept the Website Terms and Conditions of Use, Privacy Policy, and this Rental Agreement (below) for Green Springs Inn.

You represent that you are 18 years of age or older.

You accept the above terms of your reservation at Green Springs Inn and agree for us to charge your credit card immediately after booking.

Rental Agreement

This Rental Agreement (“Agreement”) is for rental of a cabin, lodge room, event space, or any combination, specified in a confirmed reservation (the “Property”). This Agreement is between: (1) Terrapin Holdings LLC doing business as Green Springs Inn ("Green Springs Inn", "we", “us,” "our"), acting for itself and for the owner of the Property, GSI LLC, (“Owner”), and (2) the person who is the responsible renter of the Property (collectively “Renter” or “you”).

By booking your rental of the Property with Green Springs Inn, you acknowledge that you have read and understand, and agree to be bound by, all terms, conditions, and policies in the Website Terms and Conditions of Use, Privacy Policy, and this Rental Agreement for Green Springs Inn (collectively, the “Terms”).

We reserve all rights to refuse service and to evict without refund any guests of the resort who do not follow or comply with resort policies. 
 

Resort Rules and General Terms

Thank you for choosing to stay with us at Green Springs Inn. We strive to provide our guests with an exceptionally clean, safe, and friendly resort experience. As our resort guests, by booking with us either directly or through a third-party marketing channel, you are agreeing that you will be responsible for yourself and any of your guests’ adherence to our resort policies and procedures. 

  1. Minimum Age: The “Minimum Age” to rent the Property is 18 years of age. You agree to provide us with proof of age upon request. 

  2. Responsible Renter: As the Renter, you agree to be an occupant of the Property for the entire duration of the rental. All other occupants will be family members, friends, other responsible adults, or minor children accompanied by a parent or legal guardian at all times. You agree to be solely responsible for your actions and the actions of all family members, guests, and invitees (collectively, “Occupants”) present at the Property at any time during your stay, and to ensure that all Occupants understand and comply with the Terms.

  3. Good Neighbor Policy: Because the Property is a resort shared by many guests, all Occupants must comply with this good neighbor policy. Please treat the Property with the same care you would use with your own residence and leave it in the same condition it was in when you arrived. To prevent theft of or damage to furnishings or your personal property, you agree to close and lock doors and windows when you are not present at the Property and upon check-out. You and other Occupants agree to conduct yourselves throughout your stay in a manner that is respectful of and not disruptive to neighboring guests, neighbors, traffic flow, or the community and that will not prompt complaints to Green Springs Inn from police, neighboring guests, neighbors, or neighborhood or homeowner associations. Noise audible outside the Property is prohibited between 10 p.m. and 8 a.m. You and other Occupants agree to abide by all applicable parking restrictions and limitations.

  4. Maximum Occupancy: The number of people present at the Property should be the number of guests specified in your booked reservation, and may not exceed the maximum posted occupancy unless we have given you advance written permission to hold an event at the Property, in which case the number of people present at the Property may not exceed the maximum number of people authorized by Green Springs Inn.

  5. No Campfires or Smoking: No campfires or smoking is permitted at the Property (including porches, decks or outdoor areas) at any time. We are in a delicate natural area with extreme wildfire risk. 

  6. No Permanent Residence: You agree that your use of the Property is on a temporary and transient basis only; that you may not use the Property as a permanent residence; and that your permanent residence is and will remain elsewhere than at the Property.

  7. Check-in: Check-in is 4pm. Green Springs Inn offers automated check-in, so if you do not require assistance, you may check in at any time after 4pm. However, if you plan to check in after 10pm, please let us know in advance so that we can ensure your check-in will still be seamless. Green Springs Inn does not have overnight staff. If you check-in after 10pm and have any issues, we may not be immediately able to assist you. If you would like to check-in early, please purchase an early check-in within our guest portal. While we do our best to accommodate an early check-in for our guests, in the event that we are unable to accommodate your request, you will be notified and refunded.

  8. Check-out: Check-out time is 10am. If you would like a later check-out, please purchase a late check-out within our guest portal. While we do our best to accommodate a late check-out for our guests, in the event that we are unable to accommodate your request, you will be notified and refunded. If you do not vacate by check-out time (or late check-out time as agreed by Green Springs Inn), you authorize us to bill your credit card on file for a late departure fee of up to one night’s rental and we may remove all Occupants and their personal property from the Property.

  9. Cleaning: Green Springs Inn is a secluded natural resort and as such we try to minimize guest interaction with housekeeping so that it feels like an undisturbed forest retreat. With that said, we offer mid-stay cleaning for all guests if desired for an additional fee. If you would like a mid-stay cleaning, please purchase it within our guest portal. While we do our best to accommodate mid-stay cleaning for our guests, in the event that we are unable to accommodate your request, you will be notified and refunded. We are happy to provide clean towels and linens upon request for no additional charge. 

  10. Parking: Green Springs Inn has ample parking onsite available free of charge for guest use only. 

  11. Guest’s Belongings: Property main entry doors operate on electronic locks. These electronic main entry door locks will automatically lock after a period of time. All other doors have manual locks. You are responsible for locking doors behind you if you leave your cabin or lodge room. Green Springs Inn is not responsible for any loss or damage to the guest’s belongings. 

  12. Pets: We love all pets, but we do not allow any pets other than dogs on the Property. In cabins, we welcome up to 2 well-behaved dogs with a fee of $50 per reservation. In lodge rooms, we welcome up to 1 well-behaved dog with a fee of $25 per reservation. If a guest is found to have more dogs in an accommodation than what is allowed, that guest will be charged a $250.00 pet fee. Dogs are required to be on leash at all times on the premises and are not allowed on furniture. Your dog(s) must be confined to a crate if left unaccompanied in cabins and may not be left unaccompanied at any time in lodge rooms. We may provide a crate upon request if one is available. If one is not available, you are responsible for providing your own crate. Please let us know in advance if you plan to bring your dog as not all cabins and lodge rooms are dog friendly. We have a limited number of rooms available for dogs and we want to ensure both our guests and their dogs are comfortable. You remain responsible for any damages caused by your dog to the room or the property and agree to pay replacement costs for any damage caused by your dog. Bona fide service animals that we are required by law to allow do not incur a fee. We kindly ask that you book a dog-friendly cabin or lodge room if you are bringing a service animal. Emotional support animals are not permitted except as authorized pets under your reservation and do incur a fee. You agree that a prohibition on animals is not a guarantee that an animal has not been inside the Property or that the Property is free of animal or pet allergens. 

  13. Minor children: Children under 14 years of age must be accompanied by an adult at all times and shall not be left unattended anywhere on the resort property at any time. In the event that a minor unaccompanied by an adult seeks accommodations, the adult, who registers for the room, assumes full liability for any and all charges and other obligation Incurred by the minor for the accommodations, food and beverages, and any other services we may provide, as well as any and all damages caused by the minor to any person or property.    

  14. Quiet hours:  Quiet hours for the property are 10pm to 8am. Please be respectful of our other guests by keeping noise level during these hours to a minimum.  

  15. Common area hours: All common areas are open to our guests 24 hours a day. You may use these areas at any time as long as you are respectful of our other guests. Excessive noise is not permitted at any time. 10pm – 8am are quiet hours. If you use the common areas during quiet hours, please be extra mindful of your noise.    

  16. No party policy: Green Springs Inn enforces a no party policy to ensure we can protect the resort and ensure the comfort of our guests at all times. No more than the listed occupancy is allowed in each unit. In the event of a disturbance, one warning will be given to reduce noise. If the warning is not followed, a penalty fee of $500 will occur. We reserve the right to ask you to leave the premises, and you agree to oblige, in which case no refund will be granted for your stay.

  17. Deposit: The full room rate is charged immediately at the time of booking. We require proper identification associated with the name on the reservation as well as the payment method. Payment may be made by acceptable credit or debit card. Guests paying by credit card acknowledge that their card will be preauthorized for all room, fee, and tax charges. Additional authorization may be taken to secure guest incidental charges. All unused authorized funds are released two days after check-out.   

  18. Room Rate: The advertised room rate does not include taxes and fees. Rates are subject to change.  

  19. Taxes and Fees: Green Springs Inn charges a State Lodging Tax of 1.5% as mandated by the state of Oregon. We also charge a cleaning fee that covers on-site amenities and ensures quality pay for our team. 

  20. Cancellation Policy: We understand that plans can unexpectedly change. Reservations may be canceled with a full refund (less 4% credit card processing service fee and credit card processor refund fee) for 24 hours after booking and 14 days prior to your check-in time. Cancellations made 14 days or less from your check-in time will result in forfeiture of 50% of your deposit (less 4% credit card processing service fee and credit card processor refund fee). Cancellations made 7 days or less will result in full forfeiture of your base nightly rate deposit. Cleaning fees and taxes will be refunded regardless of when your cancellation is made. Should you need to change or cancel your reservation, please email relax@greenspringsinn.com or call 541.890.6435. For group bookings, or reservations that are part of a group booking, cancellations must be made within 21 days of your check-in time. Cancellations made within 21 days risk a forfeiture of the total booking. For Resort buyouts, cancellations must be made 30 days before your check-in time. Cancellations made within 30 days result in a forfeiture of the total booking. Except as expressly provided in this Agreement, no refunds or compensation will be given and Green Springs Inn shall not be liable to you for failure to make the property available for occupancy if the property is unavailable or becomes partially or wholly unusable for any reason outside Green Springs Inn’s control, including but not limited to adverse weather conditions, natural disasters, mechanical failures, evacuation orders or other acts of government agencies, or utility outages. Green Springs Inn advises guests to obtain appropriate and comprehensive travel insurance that covers Renter and all Occupants and that includes coverage for personal injury, illness or disease, and property damage or loss.

  21. Damage: Guests are responsible for treating Resort Property and amenities with respect. The person or persons responsible for the reservation will be charged for the replacement or repair of Resort Property or guest rooms, including damages caused by guests or pets.    

  22. Decorations, Soft goods, and other items: If you fall in love with any of the items located on the property, including but not limited to, decorations, towels, robes, linens, mugs, glassware, etc…, please inquire with our team and we will point you to where they can be purchased. If you take them from the property, a charge will be applied to replace the item.  

  23. Commercial Use: Without the express written consent of Green Springs Inn, no commercial photography or filming is permitted on the property. 

  24. Tents: Without the express written consent of Green Springs Inn, tents or other structures may not be erected. 

  25. Cameras: For your protection and ours, we have installed cameras and trail cameras throughout the property in public, common areas. 

 

Additional Terms And Conditions
  1. Travel Insurance: Green Springs Inn advises guests to obtain appropriate and comprehensive travel insurance that covers Renter and all Occupants and that includes coverage for personal injury, illness or disease, and property damage or loss, and to help protect against financial loss if you must cancel your reservation. 

  2. Maintenance or Housekeeping Issues; Property Conditions: The Property is provided as is, and we are not responsible for the inoperability or unavailability of any amenities. You agree to contact Green Springs Inn, using the contact information provided in your confirmation email or guest portal, as soon as you notice any maintenance or housekeeping problem, or any potentially hazardous condition, at the Property, or if any incident occurs at the Property that is related to such a problem or condition. You further agree to give Green Springs Inn a reasonable amount of time to respond to your report and to cooperate with Green Springs Inn’s efforts to address the concern or provide a remedy. We will take reasonable and appropriate steps to remedy any reported problem as soon as practicable. We may enter the Property at your invitation to remedy any problem you report, at reasonable times and with reasonable notice to inspect, maintain, or repair the Property, and to address any situation that we reasonably deem an emergency that threatens persons or property. 

  3. Choice of Law: This Agreement shall be governed by laws of the State of Oregon, U.S.A, without regard to its conflict-of-law provisions.

  4. Dispute Resolution and Arbitration Agreement: You agree to resolve any dispute arising out of or relating in any way to this Agreement as follows:

a) Agreement to Arbitrate. Except as otherwise provided in this section, you and Green Springs Inn mutually agree that any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Payment of filing, administration and arbitrator fees will be governed by the AAA's rules. To begin an arbitration, a party must send a letter to the other party requesting arbitration and describing the claim. If Green Springs Inn requests arbitration, it will send the letter to your most recent email or physical address in Green Springs Inn’s records. If you request arbitration, you must send the letter to Green Springs Inn’s registered agent in the state of Oregon.

b) Place of Arbitration. Except as otherwise required by AAA's Consumer Arbitration Rules, the arbitration shall take place in Jackson County, Oregon.

c) Exceptions to Arbitration Requirement. As the only exceptions to the parties' agreement to submit all disputes to binding arbitration as provided herein, Green Springs Inn and Renter both retain the right to pursue: (1) in small claims court in Jackson County, Oregon, any claim that is within that court’s jurisdiction, and the parties consent to the personal jurisdiction and venue of such court, and Green Springs Inn further consents to Renter's appearance by telephone or video in lieu of personal appearance, if allowed under applicable court rules; and (2) a suit in any court with jurisdiction to enjoin (whether by temporary, preliminary, or permanent injunctive relief) infringement or other misuse of intellectual property rights.

  1. Class Action and Jury Trial Waiver: The parties agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration, the parties waive any right to a jury trial.

  2. Acknowledgment & Disclaimer: You acknowledge the Property may have features, amenities, and conditions that are unfamiliar to you and other Occupants you invite to the Property. You further acknowledge that your use of the Property and its amenities may carry inherent risk, including risk of bodily injury, illness or disease, disability, or death. For example, some Properties include natural habitats for wildlife, insects, and pests that may expose you to injury or disease; or docks, stairways, porches, ledges, cliffs, hot tubs, and other unmarked natural or manmade features, amenities, and conditions that carry inherent risk. You agree that, by using the Property or its amenities, you voluntarily and willfully assume those risks and assume full responsibility for the choices you make before, during and after your use of the Property and its amenities. You also acknowledge and agree that you and any other adult Occupants are solely responsible for closely supervising and protecting the health and safety of any and all Occupants that are minors, throughout the duration of your stay.

  3. Disclaimer of Warranties: TO THE MAXIMUM EXTENT PERMITTED BY LAW, GREEN SPRINGS INN AND OWNER EACH EXPRESSLY DISCLAIM ANY WARRANTIES OF SAFETY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, AND AS TO THE ADEQUACY OF THE DIRECTIONS AND WARNINGS PROVIDED TO YOU.

  4. Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO CASE SHALL THE OWNER OF THE PROPERTY OR GREEN SPRINGS INN, NOR THEIR AFFILIATES, NOR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR OWNERS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, OR FOR ANY DAMAGES FOR PERSONAL OR BODILY INJURY, ILLNESS OR DISEASE, EMOTIONAL DISTRESS, OR DAMAGE TO PROPERTY, ARISING OUT OF OR IN CONNECTION WITH YOUR STAY AT THE PROPERTY. THIS LIMITATION APPLIES TO ALL CLAIMS FOR DAMAGES WHETHER BASED ON A THEORY OF WARRANTY, CONTRACT, TORT (INCLUDING ORDINARY NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF GREEN SPRINGS INN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE AND EVEN IF THE LIMITED REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

  5. Indemnity: You agree to hold harmless and indemnify Green Springs Inn and Owner, and their respective affiliates, for and from all claims for property damage, personal injury, illness or disease, or monetary loss resulting from your actions or omissions, and the actions or omissions of other Occupants, during or relating to your stay.

  6. Substitution of Property: On rare occasions, due to ownership changes, properties being removed from rental use, or a need for extensive repairs or maintenance, the Property may not be available for rental on the dates of your reservation. In this unlikely event, Green Springs Inn reserves the right to substitute a comparable property. If comparable accommodations are not available, you will have the option of (1) selecting from other available properties (in which case you are responsible for, or will receive the benefit of, any difference in cost) or (2) receiving a complete refund of your reservation payment. In the event of a substitution of rental properties, all Terms in this Agreement shall apply to your stay in the substituted property.

  7. Assignment: Green Springs Inn may assign this Agreement or any of its rights, or delegate any of its duties under this Agreement, at any time without your consent.
